Our Purpose, Work and Duties
Our aim is;
To provide more effective and high quality services in all areas we provide service in our university, based on the principle of the rule of law, in accordance with the mission and vision of our university, by taking advantage of technological developments and considering the principles of transparency and reliability. Our University Legal Consultancy provides the conditions where employee quality will be highlighted and employee motivation and satisfaction will be increased by utilizing modern management techniques in order to keep the service quality at the highest level. The Legal Consultancy makes in-house training and information plans in order to keep the quality and efficiency in the service at the highest level by instantly adapting to the developing and changing legal needs. It ensures that the personnel know every job done in the unit in order to increase the satisfaction levels of the service recipients. In this context, it adopts the principles of transparency, accountability and continuous improvement by considering the strategic goals of the university in all its activities. In addition to these, increasing awareness about the Integrated Quality Management System-EKYS in our unit and ensuring more effective implementation of YÖKAK Service Accreditation processes are among our main goals and duties. The Legal Consultancy was established in 2008, in accordance with the a paragraph of the Additional Article 97 of the Law on Higher Education Institutions No. 2809, which is the date of establishment of BAYÜ, in order to carry out the work and transactions that fall within its area of ​​responsibility in line with the mission of BAYÜ.


Duties, Authorities and Responsibilities of our Legal Advisor:

1. To perform the duties in Article 35 of “Higher Education Law No. 247”, “Civil Servants Law No. 657”, “Electronic Signature Law No. 5070”. “Decree Law No. 124 on Higher Education Supreme Organizations and Administrative Organization of Higher Education Institutions”.
2. To ensure that the legal services of the university are carried out without interruption.
3. To provide coordination, in-service training and supervision for lawyers and other personnel working in the consultancy.
4. To ensure cooperation between the Legal Advisory and other units affiliated to the University.
5. To ensure that legal services are carried out in accordance with current legislation, to supervise and organize them.
6. To ensure that documents received by the consultancy are received, recorded and forwarded to the relevant person against signature.
7. To prepare reports and provide information when necessary and requested regarding the transactions carried out by the legal advisory.
8. To determine the documents that need to be stored, destroyed and sent to the archives by the end of the year and to ensure that the relevant procedures are carried out.
9. To examine the content and format of the letters and files prepared by the officers of the unit in question and to ensure that the necessary corrections are made.
10. To monitor and ensure that the recording, duplication, distribution, filing, dispatch and archiving services of incoming and outgoing documents are carried out.
11. To ensure that the documents received by the Consultancy are received against signature, recorded and forwarded to the relevant person.
12. To be able to use verbal and written communication channels effectively,
13. To exhibit behaviors in accordance with professional ethics.
14. To fulfill all duties assigned within the scope of the Quality Management System.
15. To participate in trainings as a Unit Manager within the scope of the QMS.


Our Lawyer's Duties, Powers and Responsibilities:

1. To represent the university as an attorney in lawsuits and enforcement proceedings filed in favor of and against the Bayburt University Rectorate.
2. To follow up on enforcement proceedings and lawsuits filed in favor of and against the Bayburt University Rectorate.
3. To participate in the preparation and implementation of the education program to be carried out by the administration.
4. To follow up on seminars, conferences and changes in legislation regarding developments in the field of law.
5. To provide opinions on legal problems arising in the Rectorate and other units.
6. To contribute to investigations conducted in the Rectorate and other units.
7. To carry out work and transactions related to the unit in which he/she is assigned.
8. To carry out other tasks assigned by the Legal Advisor.
9. To develop the professional competence required by his/her duty.
10. To review the documents prepared by the Unit Management Representative within the scope of the QMS.
11. To act jointly with the personnel in the unit in documents that need to be prepared within the framework of the Quality Management System, and to provide support when necessary numerical data is involved.
12. Participating in trainings with the Unit Management Representative within the scope of QMS.

Duties, Authorities and Responsibilities of our Officer:

1. To carry out the transactions regarding incoming and outgoing documents of the Legal Consultancy via E-BYS and with wet signatures and to ensure that official correspondence is carried out.
2. To ensure that the Legal Consultancy communication, meeting and program organizations are carried out.
3. To follow up on the permission and report works of the Legal Consultancy personnel.
4. To carry out the assignment/travel procedures of the Legal Consultancy personnel.
5. To participate in the preparation works and practices of the training program to be carried out by the administration.
6. To organize movable registration and control transactions, movable transfer, entry-exit transactions and movable management account tables.
7. To carry out the transactions aimed at resolving the malfunction in any malfunction process in the Legal Consultancy.
8. To deliver the documents to be sent to the courts and the notifications to be made to the persons.
9. To make the payment of court fees and similar expenses to the relevant places by taking advance/credit.
10. To carry out the work and procedures related to the unit in which he/she is assigned.
11. To carry out other tasks assigned by the Legal Advisor.
12. To fulfill all duties given within the scope of the Quality Management System.
13. To participate in trainings as a Unit Management Representative within the scope of the QMS.
14. To deal with the work and procedures to be done regarding the unit as BYT.
